It is not uncommon for health care organizations to discover issues within their agencies that they believe could potentially be outside the many regulatory prohibitions, including what might constitute fraud and abuse. The OIG has developed a formal program where organizations that discover these types of violations can voluntarily report these issues and potentially receive lower penalties. Alternatively, CMS has also developed a system to formally disclose any Stark violations.
